Navigating the New Changes to Open Work Permits for Family Members of Temporary Residents

As of January 21, 2025, significant changes are coming to Canada’s open work permit (OWP) eligibility for family members of international students and foreign workers.

These updates, announced by Immigration, Refugees and Citizenship Canada (IRCC) on January 14, 2025, aim to strengthen the integrity of Canada’s temporary resident programs while aligning with the country’s economic goals and labor market needs.

Here’s what you need to know:

What’s Changing?

Eligibility for Family OWPs

For International Students:

  • Spouses will only be eligible for a family OWP if the international student is enrolled in:
    • A master’s program of at least 16 months in duration
    • A doctoral program
    • Select professional and eligible programs (details to be confirmed)

For Foreign Workers:

  • Spouses will only qualify if the foreign worker is employed in:
    • TEER 0 or 1 occupations
    • Select TEER 2 or 3 occupations tied to sectors facing labor shortages or aligned with government priorities. These include:
      • Natural and applied sciences
      • Construction
      • Healthcare
      • Natural resources
      • Education
      • Sports
      • Military sectors
  • Additionally, the foreign worker must have at least 16 months remaining on their work permit at the time of the spouse’s OWP application.

Dependent Children

Dependent children of foreign workers will no longer be eligible for a family OWP under these new measures.

What Stays the Same?

  • OWPs approved before January 21, 2025, will remain valid until their expiration.
  • Family members already in Canada can apply to renew their OWPs, provided:
    • The renewal request is under the same criteria as the current permit.
    • The requested duration matches the existing study or work permit of the principal applicant.

Exceptions

  • Spouses of workers covered by free-trade agreements and those transitioning to permanent residence will not be affected by these changes.
  • Family members who no longer qualify for a family OWP can explore other work permit options within Canada’s diverse work permit programs.
